Updated Covid-19 Closure Right to Know Requests

On March 6, 2020, Pennsylvania Governor Tom Wolf issued a statewide Emergency Declaration due to the COVID-19 outbreak. This Emergency Declaration allowed for the suspension of strict compliance with laws and regulations impacted by COVID-19 and related mitigation efforts. On March 13, 2020, in an attempt to mitigate the spread of COVID-19, the Governor closed all schools, effective on March 16, 2020.

On March 15, 2020, the School District closed the administration building (the “Millcreek Education Center”) as an additional mitigation effort. Additionally, staff were directed to only work on essential matters, such as redesigning the education delivery model to an online format. As the District was determined to be closed, it was unable to accept Right-to-Know requests, and in compliance with the allowances of the Governor’s Emergency Declaration, processing of Right-to-Know requests were suspended.

On May 1, 2020, the Governor announced that, on May 8, 2020, Erie County would move to the “yellow” phase of reopening, which allows for a phased reopening of businesses and public buildings. Although the Millcreek Education Center remains closed, the School District has determined that, as of May 11, 2020, it will begin processing Right-to-Know Requests that are able to be processed remotely. Requests that will require the accessing and review of physical records will not be processed until the Millcreek Education Center is fully reopened. This policy complies with the Office of Open Records Advisory for agencies to process Right-to-Know Requests to the greatest extent of our ability to do so during the period covered by the Governor’s Emergency Declaration.

Covid-19 Closure and Right to Know Requests

Due to school closure and stay at home orders issued by the Governor, the Administrative Offices of the Millcreek Township School District have been closed since March 15, 2020. As a result, the School District has been unable to process Right-to-Know Requests. All Right-to-Know requests received between March 15, 2020 and the date that Administrative Offices are reopened will be processed in the order that they were received.
